1. Notice Regarding Acceptance

This Risk Warning & Disclaimer forms an integral part of the Mosavi Terms of Use. By clicking “I Agree” or by accessing or using the Service, you acknowledge that you have read, understood, and accepted the risks and limitations described herein.

2. General Nature of the Service

Mosavi is a decentralized social communication platform. We provide end-to-end encrypted messaging, group chat, and anonymous content-sharing features. We do not provide, operate, manage, or control any digital asset wallets, custodial infrastructure, or financial transaction services of any kind.

Where available, certain optional financial features (such as wallet access, digital asset transfers, or Red Packet gifting) are made accessible through direct integration with an independent third-party Custody Partner, which operates entirely separately from Mosavi. Mosavi is not a financial institution, exchange, wallet provider, or payment intermediary.

3. No Financial, Legal, or Tax Advice

Nothing in the Mosavi App or platform, including user interfaces, third-party integrations, or technical components, constitutes:

- Investment, trading, or financial advice

- Legal or regulatory guidance

- Tax advice or compliance verification

You are solely responsible for seeking independent professional advice before engaging in any financial or blockchain-related activity.

4. Third-Party Custody Disclaimer

All wallet, deposit, withdrawal, and digital asset-related services are provided exclusively by a third-party Custody Partner. By using these features, you engage directly with that third party and are subject to their terms, privacy policy, and compliance requirements.

Mosavi:

- Does not provide digital asset custody or wallet functionality

- Does not access or store users' private keys or digital assets

- Does not monitor, authorize, or validate transactions

- Does not participate in any KYC/AML verification process

- Assumes no responsibility or liability for wallet functionality, transaction execution, or asset security

Any risks, losses, disputes, or obligations arising from use of the Custody Partner’s services are solely between you and the Custody Partner. Mosavi is not a party to any agreement, transaction, or dispute between you and the Custody Partner. You are solely responsible for reviewing their terms and conditions.

5. Digital Asset Risks

Digital assets carry significant risks. You acknowledge and agree to the following:

- Price Volatility: Token values may fluctuate widely and unpredictably.

- Irreversibility: Blockchain transactions, once confirmed, cannot be reversed or recovered.

- Custodial Risk: Custody of assets lies entirely with the Custody Partner.

- Technology Risk: Smart contract bugs, network outages, and malicious attacks may occur.

- Regulatory Risk: Laws regarding digital assets may change without notice and affect legality or usability.

6. No Warranties

To the maximum extent permitted by law, Mosavi makes no representations or warranties about:

- The availability, accuracy, or reliability of any wallet or financial integration

- The functionality or legality of any digital asset service provider

- The security, performance, or uptime of blockchain networks

- The fitness of the Service for any financial or investment purpose

The Service is provided “as is” and “as available” without warranties of any kind.

7. Limitation of Liability

Mosavi shall not be held liable for any damages, losses, or liabilities of any kind (whether direct or indirect) arising from:

- Your use of or inability to use any wallet or financial feature

- Custody Partner system failures or operational errors

- Private key compromise, phishing, or account hijacking

- Regulatory restrictions or asset seizure

- Network congestion, gas fees, or transaction failure

This limitation applies regardless of the theory of liability, whether based on contract, tort, negligence, strict liability, or otherwise.

8. Geographic Restrictions

Some features (including financial ones) may not be available in your jurisdiction due to regulatory or technical reasons. It is your sole responsibility to determine whether your access and use are lawful. Use of the Service from or on behalf of sanctioned countries, entities, or persons is strictly prohibited. Mosavi reserves the right to restrict or disable access to any features based on your jurisdiction, IP address, or regulatory obligations.
